The short version
- Send a complete notice and infringing content comes down promptly.
- If your content was removed by mistake, a counter-notice is read by a person.
- Repeat infringers lose their accounts.
A summary for convenience, not part of the document. The numbered sections below govern.
Reporting infringement #
We respond to notices of claimed infringement under the US Digital Millennium Copyright Act and similar laws. Send notices to our designated agent at support@stacklumen.com, with the subject "Copyright notice". A notice must include:
- your physical or electronic signature;
- the work you claim is infringed;
- the address of the material you claim infringes it, precise enough for us to find it;
- your name, postal address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
- a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.
We review complete notices promptly, remove or disable the material, and tell the person who posted it. An incomplete notice may not be acted on. Knowingly misrepresenting that material infringes can make you liable for damages.
If your content was removed #
If you believe a removal was a mistake or a misidentification, reply with a counter-notice that includes your signature; the material removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and telephone number, with your consent to the jurisdiction of the federal court for your district (or, outside the US, any district where Stacklumen may be found) and to accept service from the person who sent the notice.
Counter-notices are read by a person. We forward a valid one to the person who sent the notice, and restore the material in 10 to 14 business days unless they tell us they have filed an action to restrain it.
Repeat infringers #
We close, in appropriate circumstances, the accounts of people who repeatedly infringe, and we may remove content or close accounts on a single serious infringement. Trademark complaints and other rights complaints can be sent the same way, and are handled under the Terms of Service.
These are the binding terms Stacklumen operates Baselumen by. The short version at the top of each document is a summary and does not change it. Nothing here is legal advice to you; if a decision depends on these terms, ask your own counsel. Earlier versions are available on request, and anything that looks wrong or unclear can be raised at support@stacklumen.com.
